JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Kadwa (Baliya Belon) P.S. Case No. 200 of 2018, registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping of minor daughter of the informant.

Submission of learned counsel for the petitioner is that the statement of victim girl recorded under Section 164 Cr.P.C. disclosed that she had gone on her own sweet will and married with the petitioner and she disclosed her age as 19 years and the court has assessed her age at 18 years. Heard learned APP also.

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest

Patna High Court CR. MISC. No.26993 of 2019(2) dt.26-04-2019 2/2 or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri Rabi Kumar, the Additional Chief Judicial Magistrate, Katihar, in connection with Kadwa (Baliya Belon) P.S.Case No. 200 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
