JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-12-2016 Heard learned counsel for the petitioners and the State. The case is under Section 307 and others Sections of the Indian Penal Code.

It has been submitted on behalf of the petitioner that there is no specific allegation against the petitioners except that they have snatched the ear-ring and they have caught hold the hair of the informant's wife and as such there is no allegation of assault against them and there is case and counter case between the parties.

Heard learned APP appearing for the State who also could not controvert the fact and submitted that there is omnibus allegation against the petitioners.

In view of the fact stated above and also considering the

Patna High Court Cr.Misc. No.51431 of 2016 (2) dt.14-12-2016 fact that the petitioners are lady, let the petitioners above named in the event of their arrest or surrender in the Court below within a period of four weeks from today, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of Sri Sandeep Patel, Judicial Magistrate, 1st Class, Jehanabad in connection with Parasbigha P.S. Case No. 104 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be liable to be cancelled.
