The petitioner seeks pre-arrest bail in connection with Town P.S. Case No. 439 of 2012 registered under Sections 420, 467, 468 and 471 read with 34 of the Indian Penal Code. It is submitted by Mr. Krishna Prasad Singh, learned Senior Advocate for the petitioner that the purchasers of the land namely, Anil Kumar Shrivastava and Sonu Kumar Tiwari have already been granted pre-arrest bail by a Bench of this Court
Patna High Court Cr.Misc. No.48600 of 2017 (2) dt.18-10-2017 vide reasoned order dated 29.10.2013 passed in Cr. Misc. No. 44556 of 2013. He submitted that so far as the petitioner is concerned, he had simply made signature on the sale deed as a witness to the sale deed and had neither identified the seller nor the purchaser.
Having regard to the submissions made above as also the reasons assigned in the order dated 29.10.2013 passed in Cr. Misc. No. 44556 of 2013 produced by the learned senior advocate in course of argument, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Aurangabad in connection with Town P.S. Case No. 439 of 2012 subject to the conditions as laid down under Section 438(2) Cr. P.C.
