Heard counsel for the petitioner and counsel for the respondents-State as well as respondent no.6. In view of extant amended provision of the guidelines subsequent to amendment dated 27.05.2019, appeal against the order passed by the District Programme Officer would lie before Divisional Commissioner.
In view of the aforesaid circumstance, writ petition is dismissed with liberty to the petitioner to avail remedy of appeal
Patna High Court CWJC No.15530 of 2011(7) dt.02-09-2019 2/2 before the Commissioner, Tirhut.
In the event appeal is preferred within a period of four weeks, Commissioner, Tirhut would examine the claim of the petitioner upon its merits and dispose of the same by reasoned and speaking order in accordance with law within the period of three months from the date of filing of the appeal.
