JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 379, 504, 506 of the Indian Penal Code and 27 of the Arms Act.

It is alleged that the accused persons variously armed with came and started making construction house on the land of the informant when it was protested the accused persons assaulted the informant. It is further alleged that co-accused Chandan Sah resorted 3- 4 rounds of firing but no injury was caused to anyone whereas co-accused Madan Paswan snatched Rs.2000/- from the pocket of the informant.

It is submitted by learned counsel for the petitioner that in the background of land dispute the accusation has been levelled

Patna High Court Cr.Misc. No.55262 of 2015 (2) dt.07-12-2015 2/2 and no injury has been caused to anyone. In fact, the present case has been lodged to put pressure on the petitioner to withdraw the earlier case filed by his wife Amerika Devi being Bihra P.S. Case No.123 of 2015 against informant's side.

Considering the accusation being levelled in the background of land dispute, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Saharsa in connection with Bihra P.S. Case No.121 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
