JUSTICE ARVIND SRIVASTAVA ORAL ORDER 11-10-2017 Heard learned counsels for the petitioners and the State. Petitioners apprehend arrest in connection with Alauli P.S. Case No. 97 of 2016 registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code. After some argument, learned counsel for the petitioners seeks permission to withdraw the application on behalf of the petitioner no. 1.

In view of the above, the application stands dismissed as withdrawn as against petitioner no. 1.

As regard other petitioners, learned counsel submits that there is case and counter case between the parties. The injury cause has been found to be simple in nature. There are no specific allegation against these petitioners. Petitioners are men of clean antecedent.

Considering the facts and circumstances of the case and the

submissions advanced on behalf of the parties, let the petitioners no. 2 to 5, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Alauli P.S. Case No. 97 of 2016 subject to the conditions laid down under section 438(2) Cr.P.C.
