2. The petitioner apprehends arrest in connection with Kharagpur PS Case No.357 of 2024 dated 15.11.2024, instituted under Sections 191(2), 190, 126(2), 115(2), 118(1), 74, 109, 352 of the Bharatiya Nyaya Sanhita, 2023.

3. The allegation against the petitioner is that he and Mukesh Tanti assaulted the informant on his head by means of lathi.

4. Learned counsel for the petitioner submitted that there is land dispute between the parties and due to this reason the petitioner and his entire family has been implicated in this false and concocted case. Further submission is that there is allegation of assault on the head of the informant by means of

Patna High Court CR. MISC. No.26668 of 2025(2) dt.07-05-2025 2/2 lathi, but the injury report does not corroborate the allegation. The injury report of the informant shows that the nature of injury is simple in nature caused by hard and blunt substance. Lastly, it is submitted that the petitioner has no criminal antecedents.

5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger, in Kharagpur PS Case No.357 of 2024.

7. The application stands allowed.
