ANJANA MISHRA ORAL ORDER 17-10-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner, being the husband, is in custody since 05.08.2018 in connection with Chanpatia (Sirisia) P.S. Case No. 184 of 2018 registered for the offence punishable under Sections 304-B, 201/34 of the Indian Penal Code. Learned counsel for the petitioner submits that there is nothing on record to indicate that the petitioner had been torturing the victim lady.
Case diary in the present case was called for which has since been received.
Learned counsel appearing on behalf of the State after perusal of the case diary submits that the death has been caused due to strangulation and, therefore, the petitioner being the husband is not entitled to the benefit of bail.
Patna High Court CR. MISC. No.24306 of 2019(9) dt.17-10-2019 2/2 Having considered the entire facts and circumstances of the case and there being cogent material in the case diary, I am not inclined to grant regular bail to this petitioner.
It is accordingly rejected.
