2. The petitioner apprehends his arrest in a case registered for the offence under Sections 379, 406, 420, 120(B) of the Indian Penal Code.

3. As per the prosecution case, co-accused Rajesh Tiwary who was driver of the truck conspired with this petitioner and others and all of them took away 590 sacks of rice which were to be delivered at Chattisgarh.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case only on the basis of suspicion. No one has seen the alleged occurrence and no incriminating article has been recovered from the possession of the petitioner and petitioner has got no concern with the driver or alleged loot.

5. Learned A.P.P. for the State has opposed the bail petition and submits that the petitioner is named in the F.I.R. and petitioner has got one criminal antecedent of similar nature.

6. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. Therefore, the prayer for bail of this petitioner is rejected. (Prabhat Kumar Singh, J) sanjeev/- U T
