The petitioner apprehends his arrest in connection with Gaya Forest P.S. Case No. 25 of 2016 for the offence punishable under Sections 33(i)(c) and 63 of the Indian Forest (Bihar Amendment) Act, 1989.
Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. Learned counsel for the petitioner further submits that from perusal of the F.I.R., it appears that there is only allegation against the petitioner is of misbehaving with forest official while the
Patna High Court CR. MISC. No.24703 of 2019(2) dt.17-04-2019 2/2 petitioner along with others were constructing the illegal hut in the forest. Hence, the petitioner may be granted the privilege of anticipatory bail.
Considering the facts and circumstances of the case, let the, above named, petitioner in the event of surrender within a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Gaya Forest Case No. 25 of 2016 subject to the conditions laid down under Section 438(2) of the Cr.P.C.
