2. The present application has been filed againt the order dated 22.09.2015 passed by learned Chief Judicial Magistrate in connection with Hisua P.S. Case No.265 of 2014 by which the learned Magistrate has taken cognizance against the petitioner under Sections 287 and 304 of the Indian Penal Code.

3. It appears that vide order dated 19.12.2023, a report regarding status of proceedings be called for. From perusal of the report dated 05.01.2024 sent by A.D.J.-II, Nawada that charge has already framed in this case and out of

Patna High Court CR. MISC. No.42352 of 2016(3) dt.12-02-2024 2/2 six charge-sheeted witnesses, one prosecution witness has already examined.

4. In view of above, after short argument, learned counsel appearing on behalf of petitioner seeks permission to withdraw the present application.

5. Permission is accorded.
