In this case, the petitioner is seeking anticipatory bail in connection with Desari P.S. Case No. 259 of 2018, registered for the offence under Sections 302, 201/34 of the Indian Penal Code.

It has been alleged that the marriage of the daughter of the informant was solemnized with the petitioner in the year 2004, but at later stage, he developed illicit relationship with another lady, which was being opposed the daughter of the informant and on that account she was being subjected to torture and later on, the daughter of the informant has been killed by the accused persons.

Looking to the nature of allegation and also the fact

Patna High Court CR. MISC. No.28223 of 2019(2) dt.30-04-2019 2/2 that the petitioner is the husband of the deceased, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order day without being influenced by the order of this Court.
