The present application has been filed on behalf of the petitioner seeking extension of time granted by this Court by order dated 9.5.2016 passed in Cr. Misc. No. 13600 of 2016, as contained in Annexure-1, whereby the petitioner was granted anticipatory bail in connection with Complaint Case No. 2073 of 2013 with a direction to furnish bail bond within a period of four weeks.

The learned counsel appearing on behalf of the petitioner submits that on account of illness of the petitioner, he could not surrender in the court below within the time prescribed by this Court. Therefore, bail bond could not be furnished and he could not get the fruit of the anticipatory bail granted by this Court.

However, taking into consideration the facts and circumstances of the case, the prayer for extension of time/ modification of the order dated 9.5.2016 is allowed.

Patna High Court Cr.Misc. No.48510 of 2016 (2) dt.23-11-2016 2/2 The order dated 9.5.2016 passed in Cr. Misc. No. 13600 of 2016 (Annexure01) is modified only to the extent that if the petitioner surrenders in the court below within a period of four weeks from today, he shall be enlarged on bail in terms of aforesaid order dated 9.5.2016.

The present application stands disposed of with the modification of the order dated 9.5.2016 passed in Cr. Misc. No. 13600 of 2016 to the extent indicated above.
