JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-09-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Sarai P.S. Case No. 112 of 2017, registered under Section 366(A)/34 of the Indian Penal Code.

The accusation is of kidnapping of the daughter of the informant by this petitioner with the help of one Shailesh Kumar. Learned counsel for the petitioner submits that, in fact, due to love affair in between the petitioner and the daughter of the informant, she left her house with the petitioner according to her own sweet will and perform the marriage in temple at Muzaffarpur, which would appear from her statement recorded under Section 164 of the Cr.P.C. and the victim, daughter of the informant, has disclosed her age as 18 years.

No.47050 of 2017 (2) dt.22-09-2017 Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate- XIII, Vaishali at Hajipur, in connection with Sarai P.S. Case No. 112 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
