2. The Respondent No.4, i.e., Bihar Police Sub-Ordinate
9/11 Service Commission (hereinafter referred to as the 'Commission') had issued Advertisement No. 01 of 2019 inviting online application for filling up 2064 posts of Police Sub-Inspector; 215 posts of Sergeant; 125 posts of Assistant Superintendent Jail (Direct Recruitment) and 42 posts of Assistant Superintendent Jail (Ex-Servicemen).
3. The petitioners in the present writ petition are 153 in numbers. The different petitioners had applied for different posts enumerated hereinabove. The examination pattern for the afore-noted posts consisted of preliminary examination followed by main examination and thereafter physical efficiency test (hereinafter referred to as the 'PET') for those who have passed the main examination.
4. The petitioners had made a request for extension of date of PET, which was processed by the Commission and even though in the cases of some of the candidates the extension of PET date was granted but before the date fixed, the extension granted was cancelled without providing any reason or granting the petitioners an opportunity of hearing, thereby denying the petitioners participation in the PET.
5. The grievance of the petitioners, therefore, is the action of the Respondent No. 4 in not allowing the petitioners to
10/11 participate in the PET examination even though they had earned the right to appear in the PET by qualifying in the mains examination.
6. It is an admitted position that the recruitment initiated pursuant to Advertisement No. 01 of 2019 has been concluded and appointments have been made. It has also come on record in the order passed by this Court on 08.07.2025 that after the recruitment pursuant to Advertisement No. 01 of 2019 was finalized there have been two more subsequent recruitments done in terms of Advertisement No. 03 of 2020 and Advertisement No. 02 of 2023 for the posts mentioned above.

Perusal of record also shows that none of the candidates selected pursuant to Advertisement No. 01 of 2019 have been impleaded as Respondents; nor, the petitioners have placed on record any material to indicate that there are any vacancies left of the posts advertised vide Advertisement No. 01 of 2019.
8. It is the settled position of law that the authorities cannot fill up more than the posts advertised. In the absence of petitioners placing on record the material(s) to indicate that such number of posts which were advertised vide Advertisement No. 01 of 2019 are still lying vacant, even if the case projected by
11/11 the petitioners is accepted to be correct by holding that great injustice has been done to the petitioners by denying their participation in the PET, no relief sought for by the petitioners can be granted under the law in the form and content the present writ petition has been filed; namely, without impleading the selected candidates as party Respondents in the writ petition.
9. The writ petition stands dismissed for non-joinder of necessary parties.
