JUSTICE CHAKRADHARI SHARAN SINGH) 24-03-2022 The petitioner is seeking a direction to the respondents to declare Lachhanmanpur under Block Benipur in the district of Darbhanga, as a Gram Panchayat. In our considered view, this Court exercising power of judicial review under Article 226 of the Constitution of India is not required to go into the issue as to which village or group of villages should be declared as Panchayat in accordance with the provisions under the Bihar Panchayat Raj Act. It is purely the discretion of the executive to take a decision in this regard.
