Certain land of the Math was acquired under the Land Ceiling Act. These land fall in village Mohammadpur. The writ application is filed under representative capacity stating that there are so many needy persons who belonged to the weaker sections of the society and entitled to settlement thereof. Section 27 of the Land Ceiling Act provides disposal of surplus land amongst the eligible categories of citizens. The petitioner has to make an application for such settlement. It is stated that the representations of the eligible persons of that village are pending

Patna High Court CWJC No.21233 of 2013 (3) dt.14-07-2016 2/2 consideration before the District Collector. Any such settlement has to be done in terms of the provisions of the Act. However, the District Collector being the head of the administration at the District level has to take a decision or issue appropriate direction. The writ application, as prayed, is disposed of permitting the petitioner and eligible persons to apply for such settlement/ allotment before the appropriate /competent authority for consideration and disposal in accordance with law. If any such representation is filed before the District Collector, the same shall receive due consideration and disposal by him in accordance with law at the earliest possible.
