The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 353, 307, 379, 414/34 of the Indian Penal Code, Section 56(2) of the Bihar Mineral Concession Prevention of Illegal Mining Transportation and Storage Rules, 2019, Section 21 of MMDR Act and Section 15 of the Environment Protection Act. The prosecution case as per F.I.R is that the

Patna High Court CR. MISC. No.27573 of 2022(2) dt.12-10-2022 2/3 informant being Mining Officer has found illegal storage of sand over the land of the petitioner.

It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case due to village politics. The petitioner is not indulged in illegal storage of sand and he had no knowledge about illegal storage of sand over his land nor he has any connection with the alleged sand. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S.
