2. The petitioner has preferred this application for grant of regular bail in connection with Manpur P.S. Case No. 231 of 2023 dated 04.12.2023 registered for the offences punishable under Section 364 of the Indian Penal Code and later Section 302, 201 and 120B read with Section 34 of the I.P.C was added.

3. As per the prosecution case, the petitioner and the co-accused person are alleged to have abducted and committed murder of the informant's husband.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.25297 of 2025(2) dt.07-07-2025 2/3 this case. The occurrence took place on 30.11.2023 but the FIR was lodged on 04.12.2023 and there is no explanation for this delay. Nothing has been recovered from the possession of the petitioner. The petitioner has no concern with the alleged occurrence. The petitioner has one criminal antecedent in which he is on bail as stated in para 3 of the bail petition. The petitioner is in custody since 11.01.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that the cause of death is asphyxia due to neck compression. As per para-81 of the case diary, the petitioner and his wife were kept under proper surveillance in the police custody. During the interrogation, the petitioner accepted his crime and told that his wife had love affair with one Mukesh Chauhan which was informed to him by the villagers. The petitioner took Mukesh Chauhan to his courtyard of the house, the petitioner and his wife got Mukesh Chauhan drunk alcohol, when he became intoxicated, the petitioner along with his wife committed murder of Mukesh Chauhan by pressing his neck and tied his feet and hands with a rope and hid the deceased in the locked house of Sikander Chauhan at late night, and next day they fled away. Considering the aforesaid facts and circumstances of the case as well as the heinous nature of offence against the petitioner, this court is not inclined to grant bail to the petitioner and the same is rejected in connection with Manpur P.S. Case No. 231 of 2023, pending in the Court of leaned Additional Sessions Judge-IIIrd, Nalanda at Biharsharif.

7. The application stands rejected and learned court below is directed to conclude the trial of the petitioner at the earliest.
