JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-12-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Delha P.S. Case No. 40 of 2017, registered under Section 409 of the Indian Penal Code.

The accusation of informant is that he is the branch Manager of Bharat Financial Inclusion Limited Branch, Gaya, doing the work of distributing the loan on low interest to old age women group. The petitioner being the Samgam Manager of the company distributed Rs.2,79,347/- to six old age women groups, but on verification, it was found that the said money was not distributed and misappropriate by the petitioner. No.39042 of 2017 (4) dt.12-12-2017 would appear from paragraphs 39 to 44 of the case diary that the beneficiaries have stated about receiving the money and also about returning the same with interest. But the informant made complaint about not utilizing the loan amount properly and made accused to the petitioner in this case with false allegation. Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-VII, Gaya, in connection with Delha P.S. Case No. 40 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
