The petitioners apprehend their arrest in connection with Hajipur Sadar P.S. Case No. 29 of 2016 registered for the offences punishable under sections 341, 324, 307 and 120B/34 of the Indian Penal Code and 27 of the Arms Act. Allegation has been made of assaulting and firing upon the victim.
Learned counsel for the petitioners submits that petitioners have falsely been implicated in the present case, they have no criminal antecedent and there is no specific allegation against them rather specific allegation is against one Dharm Nath
Patna High Court Cr.Misc. No.216 of 2017 (4) dt.01-05-2017 2/2 Singh, who alleged to have fired upon the victim. He further submits that earlier one case has been filed by the side of the petitioners against the informant.
Considering the facts and circumstances of the case, the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, are directed to be released on bail on furnishing bail bond of Rs.10,000/-each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 29 of 2016, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure. (Arvind Srivastava, J) Mahesh/- U T
