The petitioner apprehends his arrest in connection with Mohania P.S. Case No.414 of 2016 registered under Sections 302/34 of the Indian Penal Code.

The accusation is that on 31.08.2016 at about 10.00 A.M., the informant received information from the Officer Incharge of Buxar Muffasil Police Station about the recovery of the dead body of his son at Mundi Tekari Road under Mohania Police Station. On receiving such information, the informant alongwith villagers Nandjee, Vinod and Upendra Yadav reached at Sadar Hospital, Bhabua, and identified the dead body of his son Vipin Kumar.

No.47670 of 2017 (2) dt.11-10-2017 2/3 Before one and half year, Vipin Kumar, the son of the informant, had kidnapped Anju Kumari, the daughter of Tej Narayan Singh, and since then, Tej Narayan Singh and his son Sureman Singh used to give threatening to the informant to kidnap his daughter. On 30.08.2016, Vipin Kumar informed his younger brother Ajay Singh on mobile that he is at Mohania Station and his wife Anju Kumari is with him and they are reaching at village but they did not reach. The informant raised suspicion about having hand of Tej Narayan Singh and his son Sureman Singh in the commission of murder of his son Vipin Kumar.

Learned counsel for the petitioner submits that, in fact, the petitioner is not named in the F.I.R. During investigation, the name of the petitioner has been disclosed by the informant in his restatement. As the petitioner is the brother of Tej Narayan Singh, due to that reason, the petitioner has also been implicated in this case.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua, in connection with
