2. The petitioner is in custody in a case registered for the offence punishable under Sections 393 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

3. Allegation against the petitioner and other coaccused persons is to have shot fired upon the shop of the informant.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that the name of the petitioner surfaced on the basis of confessional statement of co-accused and no test identification paraded has been conducted during course of investigation,

Patna High Court CR. MISC. No.27473 of 2025(2) dt.07-05-2025 2/2 petitioner is in custody since 17.01.2024 and from perusal of the impugned order, it appears that there is no progress of the trial in near future.

5. Learned APP for the State opposes the prayer for regular bail of the petitioner.

6. In view of the aforesaid facts as also the fact that petitioner is in custody for more than one year, so I am inclined to grant bail to the petitioner. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Vikash Kumar, Judicial Magistrate, Ist Class, Gopalganj/concerned Court in connection with Gopalganj Town P.S. Case No. 885 of 2023, subject to the condition that petitioner shall appear before the trial court till conclusion of the trial.
