JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-12-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,452,341,323,325,427,354,379 and 307/504 of the Indian Penal Code.

The prosecution case is that on 21.11.2014 the informant was at her house when her husband went to some other place, the petitioners being neighbours came and abused the informant, on protest being made the accused persons assaulted to the informant, her daughter, son and brother in law (Debar) by means of lathi and stick causing injury. The accused persons also took away seven thousand rupees. The motive of the occurrence is alleged to be annoyance during purchase of land by the informant from her agnate Raj Kumar Sah.

No.54299 of 2015 (2) dt.01-12-2015 2/2 It is submitted by the learned counsel for the petitioners that the accusation is omnibus and general and the injury has been found to be simple in nature. The petitioners are agnates of the informant and maliciously the case has been lodged. It is further submitted that co accused Rajesh Yadav has been granted anticipatory bail vide Cr. Misc. No. 24043 of 2015. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Munger in connection with Dharhara P.S. Case No.179 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
