JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 02-01-2024 At the outset, Mr. Madhusudhan Kumar, learned counsel for the petitioner, submits that the petitioner has filed a recall petition in the court of learned Principal Judge, Family Court, Madhubani and he is pursuing his remedy in the learned court below. It is stated in the interlocutory application also that a date has been fixed on the recall petition.

2. Since the petitioner is already pursuing his remedy in the learned court below, learned counsel for the petitioner seeks permission to withdraw this application with liberty to proceed with the recall petition.

3. Having regard to the aforesaid submissions, this application is permitted to be withdrawn with liberty to the petitioner to pursue his recall petition. The learned Principal
