2. The petitioner apprehends arrest in connection with Sarairanjan P.S. Case No. 31 of 2024 dated 04.03.2024, instituted for the offence punishable under Sections 363, 366(A)/34 of the Indian Penal Code.

3. The prosecution case, in short, is that on 19.02.2024 at about 01:00 am, the daughter of the informant went to attend the call of nature then the accused persons including the petitioner kidnapped her.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this

It is further submitted that in the statement recorded under Section 183 of the B.N.S.S.,2023, the daughter of informant herself admitted that she got married with the petitioner at Delhi and nobody has kidnapped her. It is next submitted that the date of birth of informant's daughter is 01.01.2005 which means that she was major at the time of incident. Lastly, it has been submitted that petitioner has no criminal antecedents.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner within a period of six weeks from today, in connection with Sarairanjan P.S. Case No. 31 of 2024, he/they shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate - 1st Class, Samastipur/ Concerned Court, Samastipur, subject to condition as laid down under Section 482(2) of the B.N.S.S.
