Petitioner apprehends arrest in a case registered for the offences punishable under Sections 448, 342/376 of the Indian Penal Code.
Prosecution's case in brief is that on 10.3.2020 at about 3 pm the petitioner came to the house of the informant and offered her colour (Rang) on the eve of Holi festival. In the meantime, he pressed her mouth and took her to the room and committed rape with her.
Learned counsel for the petitioner submits that in fact that informant had taken Rs.10,000/- from the petitioner and when he demanded the same, she lodged this false case. Victim is married lady with three children and the doctor did not find
Patna High Court CR. MISC. No.27281 of 2020(2) dt.06-11-2020 2/2 any injury on the person on her medical examination. Petitioner has got no criminal antecedent.
Learned counsel for the State opposes the prayer for bail submitting that the victim, in her section 164 Cr.P.C. statement, has supported the prosecution case. Considering the gravity of the allegation against the petitioner his prayer for bail is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
