For issuance of appropriate writ in nature of mandamus commanding the respondent's authorities to remove the encroachment from the gairmazrua aam public land/pond situated at Thana No.

144, Khata no. 01, Tauzi no. 493/6352 and plot (khesra) no. 1958, under circle Mashaurhi, Nagar Parishad Mashaurhi, Patna, Bihar.

(b) For issuance of appropriate writ to

Patna High Court CWJC No.11433 of 2021(2) dt.13-10-2022 2/3 commanding the respondent's authorities for physical verification and measurement aforementioned land area and reconstruct the pond for save of Jal Jeevan Hariyali, Government Scheme."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Executive Officer, Nagar Parishad, Mashaurhi, Patna / Circle Officer, Mashaurhi, Patna for redressal of his aforesaid grievance. Liberty so sought is granted.

It is needless to state that in case the petitioner approaches the Executive Officer, Nagar Parishad, Mashaurhi, Patna / Circle Officer, Mashaurhi, Patna by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith.
