The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 3 of the Railway Property (U.P.) Act Co-accused Sikandar Mahto was apprehended by the police while he was carrying stolen property of railway track. He disclosed the name of the petitioner. The petitioner has stated on oath that he has got no criminal antecedent and only material is the confessional statement of co-accused.

Considering the facts and circumstances of the case, let, the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt of the order, be released on bail on

Patna High Court Cr.Misc. No.50557 of 2016 (2) dt.23-11-2016 2/2 furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Barauni/Successor Court in connection with Barauni R.P.F. Case No. 05 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
