Let the defect(s) be removed within four weeks of the complete start of the physical Court in normal course. The petitioner is in judicial custody in connection with Mufasil P.S. Case No.401/2021 instituted under Sections 341,323,498A,307,504,506 of the Indian Penal Code, 1860. As per the prosecution story, the informant has alleged that after the solemnization of marriage, the informant was blessed with three daughters and her husband was always used to torture her and it is further allegation that he has performed another marriage with second lady and has stopped giving any money to her or children for their maintenance and

Patna High Court CR. MISC. No.26827 of 2022(2) dt.31-08-2022 2/2 after being thrown out are living at her father's house with children. The further allegation is that on 06.08.2021, the petitioner came to her father's house and again started assaulting her. Upon objection it is alleged that he wrapped 'Gamcha' around her neck and that resulted into her felling down on the ground whereafter he gave fist blows and severely assaulted. The family members rushed to her rescue and thereafter she was brought to Sadar Hospital, Motihari for treatment whereafter this FIR has been lodged.

Considering the gravity of allegation that has been levelled against the petitioner herein, this Court is not inclined to grant any relief to him and the bail application is hereby rejected.
