The writ petition has been filed praying for issuance of a writ in the nature of mandamus commanding the respondents to facilitate the construction of school building on a piece of land bearing Khata No. 32, Survey Plot No. 416 having an area of five and half decimals situated in village Bangra in the district of Muzaffarpur stated to have been donated by the petitioner. A counter affidavit has been filed in which it is stated

Patna High Court CWJC No.515 of 2014 (2) dt.03-07-2015 that construction of the school building had already started on plot bearing Khata No. 39, Khesra No. 313 having an area of 12 decimals which had been donated by one Shiv Prasad Singh son of Late Chalti Singh and that the construction of the school building is almost complete.

In the circumstances discussed and in view of the information placed on record by the State which has not been controverted by the petitioner by filing any rejoinder, I do not deem it expedient to keep the writ petition pending and which is accordingly disposed of.
