JUSTICE SANJAY PRIYA ORAL ORDER 20-09-2017 The petitioner was granted anticipatory bail vide order dated 30-03-2017 passed in Cr. Misc. No. 7430 of 2017. The petitioner did not surrender in terms of aforesaid order. Thereafter, the order dated 30-03-2017 was modified by order dated 26-07-2017 passed in Cr. Misc. No. 34894 of 2017 and, three weeks' further time was given to the petitioner to surrender in the court below but the petitioner did not comply with the aforesaid order.

This second modification application has been filed by the petitioner to modify the order dated 26-07-2017 passed in Cr. Misc. No. 34894 of 2017.

The attitude of the petitioner shows his negligence and careless approach.

In such circumstances, this court is not inclined to modify the earlier modification order dated26-07-2017 passed in

Patna High Court Cr.Misc. No.46370 of 2017 (2) dt.20-09-2017 2/2 Cr. Misc. No. 34894 of 2017. Accordingly, this modification application is dismissed.

The petitioner is directed to surrender in the court below and seek regular bail, which will be considered by the court below on its own merit without being prejudiced by this order and the same shall be disposed off on the same day. (Sanjay Priya, J) A.K.V./- U T
