The petitioner is in judicial custody in connection with Sangrampur P.S. Case No. 292 of 2021 for the offences under Sections 341, 323, 307, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the FIR, on 12.11.2021, as the informant and his family returned after 'mundan' ceremony of her grand daughter, it is alleged that accused persons started abusing them and upon opposition, it is alleged that this petitioner opened fire causing injury on the right hand of her son.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.27290 of 2022(2) dt.31-08-2022 2/3 said injury is simple in nature and he has already suffered by being in custody since 13.11.2021.

Considering the fact that the injury is simple in nature and the petitioner is in custody since 13.11.2021 (as stated in paragraph-12 of the bail application) as also the fact that charge sheet stands submitted, this Court is inclined to grant him the privilege of bail.

Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Munger in connection with Sangrampur P.S. Case No. 292 of 2021, subject to the following conditions:- (i) one of the bailor should be the family member of the petitioner, who shall provide official document to show his/her bona fide;

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reasons will entail his cancellation of bail by the Trial Court itself;

(iv) he shall in no way try to induce or promise or threat the witnesses or tamper with the evidence, failing which the State shall be at liberty to take steps for cancellation of his

With the aforesaid observations, the bail application is allowed.
