1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offence punishable under Section 304(B)/34 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that Shiv Lagan Mahto along with two others had approached this Court seeking anticipatory bail by filing Cr. Misc. No. 10130 of 2024 and the same was allowed by an order dated 29.02.2024. It is further submitted that Shiv Lagan Mahto and two others were cousin fathers-in-law of the deceased. It is next submitted that petitioner is maternal mother-in-law of the deceased. It is also submitted that the informant alleges that the accused persons including the petitioner were instrumental in torturing and assaulting the deceased for non-fulfillment of the dowry
Patna High Court CR. MISC. No.29077 of 2024(3) dt.28-06-2024 2/2 demand. It is further submitted that petitioner has no concern with day-to-day affair of the husband of the deceased or his family members. It is next submitted that whenever any such occurrence as alleged in the FIR takes place, the entire family members are implicated in a mechanical manner with general, omnibus and ornamental allegation. It is also submitted that informant is not an eyewitness to the occurrence. It further submitted that petitioner is in custody since 03.12.2023.
4. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
5. Considering the submissions aforesaid, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Chapra Town P.S. Case No. 586 of 2023.
