The petitioner prays for anticipatory bail in connection with Piro P.S. case no. 138 of 2016 registered for the offences punishable under Sections 304(B), 201, 34 of the Indian Penal Code.
It has been submitted on behalf of petitioner that no case u/s 304(B) of IPC is made out as the occurrence occurred after 7 years of marriage and secondly informant himself filed a petition in lower court that deceased died in course of cooking by burn injuries. Other co-accused have been granted bail by this Hon'ble court.

Patna High Court Cr.Misc. No.52113 of 2016 (2) dt.21-12-2016 2/2 Having heard both sides, in view of the fact that there are allegations in the FIR against the petitioner and petitioner is the husband of the deceased, I am not inclined to grant anticipatory bail to the petitioner and is accordingly rejected. However, petitioner is directed to surrender before the court below and the court below after considering the submissions made by the petitioner, will pass appropriate order on its own merit without being prejudiced by the order of this Court.
