The petitioner apprehends his arrest in connection with Laheria Sarai P.S. Case No. 247 of 2017, registered under Sections 379 and 308 of the Indian Penal Code. The accusation is of driving the Tempo rashly and negligently by the petitioner in the busy market at Darbhanga Town.
Learned counsel for the petitioner submits that, in fact, petitioner, who is the driver of the Tempo, has falsely been implicated in this case due to non-fulfillment of illegal demand by the police.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the
Patna High Court Cr.Misc. No.46638 of 2017 (2) dt.22-09-2017 event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga, in connection with Laheria Sarai P.S. Case No. 247 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
