The petitioner seeks bail in connection with Bhagwanpur Police Station Case No. 33 of 2023 registered for the offence under Sections 307, 341, 323, 379, 504, 506 and 34 of the Indian Penal Code.
The allegations against the accused persons including the petitioner herein, are of firing and assaulting the informant's brother who was at his C.S.C Centre, due to which the brother of the informant received injury on his head. Thereafter, one coaccused looted Rs.25,000/- from the C.S.C centre. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.29109 of 2023(2) dt.24-05-2023 2/2 petitioner has been falsely implicated in the case. There is no specific allegation against the petitioner and he is in custody since 14.02.2023.
Learned A.P.P. has vehemently opposed the prayer for bail.
Considering the nature of allegations levelled against the petitioner, this application for regular bail is allowed. Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Kaimur at Bhabua in connection with Bhagwanpur Police Station Case No. 33 of 2023.
