Heard learned counsel for the petitioners, learned A.P.P. appearing on behalf of the State and learned counsel for the informant.

The petitioners apprehend their arrest in connection with Bhagwanpur P.S. Case No. 33 of 2023 registered under Sections 341, 323, 307, 379, 504, 506 and 34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case due to enmity. Further submission is that the specific allegation is against the co-accused Dau Yadav. The allegation against the
Patna High Court CR. MISC. No.28743 of 2023(2) dt.21-07-2023 2/2 petitioners is of firing but no fire arm injury has been found.

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial MagistrateV, Kaimur at Bhabua in connection with Bhagwanpur P.S. Case No. 33 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
