ANJANA PRAKASH ORAL JUDGMENT Date: 20-06-2016 The Petitioner seeks revision of the judgment of conviction dated 18.1.2007 passed by the Additional District & Sessions Judge, F.T.C. No.5, Katihar in Criminal Appeal No.105 of 2006/Trial No.13 of 2006, by which he has upheld the conviction of the Petitioner under the provisions of Arms Act and maintained the sentence of 3 years R.I. and fine of Rs.5000/-, in default of which simple imprisonment for another six months, passed by the Judicial Magistrate, 1st class, Katihar in G.R. No.871 of 2004/ Trial No.1129 of 2006 by judgment dated 22.9.2006.
On going through the impugned judgment, I do not find any merit in the revision. However, considering the period of custody of the Petitioner as also the date of occurrence, the sentence is modified to the period already undergone by him. The realization of
Patna High Court CR. REV. No.359 of 2007 dt.20-06-2016 2/2 fine of Rs.5000/- imposed upon the petitioner is also waived. With the aforesaid modification in sentence, the revision application stands dismissed.
