The petitioner apprehends his arrest in a case registered under Sections 420, 467, 468 and 471/34 of the Indian Penal Code.

Petitioner along with other accused persons are said to have provided activated SIMs to the unscrupulous persons on lucrative value who are indulged in cheating gullible consumers alluring them for on line purchasing of the articles.

It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in the case. Aforesaid case was initiated on the disclosure of Pratipal

Patna High Court CR. MISC. No.31397 of 2019(2) dt.10-05-2019 2/2 Kumar @ Rakesh Kumar, accused of Warisaliganj P.S. Case No. 190 of 2019 and on his disclosure Sri Ram Hello Centre was raided and some SIMs were seized and one person namely Arvind Kumar was apprehended. But the aforesaid accused Pratipal Kumar @ Rakesh Kumar has not named the petitioner in the occurrence and none has also disclosed the complicity of the petitioner in the occurrence. No incriminating article has been recovered from the conscious physical possession of the petitioner. He has no concern with the said shop. Petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nawada in connection with Warisaliganj P.S. Case No. 73 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
