JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 120B, 467, 468, 420, 320, 447 and 504 of the Indian Penal Code.

The prosecution case is that the accused persons started constructing boundary wall on the land of the petitioner being Plot Nos.1433 and 1436, khata no.142. On protest being made the accused person shown some forged sale deed.

It is submitted by learned counsel for the petitioner that petitioner is the absolute owner of the alleged land as his grandfather late Jaggu Thakur acquired the said land in 1919 through a registered sale deed. Hence, the claim of the informant to acquire the land, in question, by his ancestors in 1935-36 is absolutely

Considering the nature of accusation in the background of serious land dispute, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Madhubani in connection with Ladaniya P.S. Case No.25 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
