JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-07-2019 This is an application for grant of anticipatory bail in connection with Noorsarai P.S. Case No. 1 of 2019, disclosing offences under Sections 147, 148, 149, 341, 323, 307, 379, 504 and 506 of IPC.

Specific allegation against the petitioner is of assault by rod to the informant, causing injury.

Submission of the learned counsel for the petitioner is that there is case and counter case between the parties and he has falsely been implicated in this case.

Heard learned A.P.P. also, who has opposed the prayer for bail by stating that injuries are grievous in nature and too on his head.

Having heard both sides, in view of the allegation and nature of injuries, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is

Patna High Court CR. MISC. No.25868 of 2019(3) dt.03-07-2019 2/2 directed to surrender before the learned court below and make prayer for regular bail, the same shall be considered by the learned court below on its own merit.
