JUSTICE ANIL KUMAR SINHA ORAL ORDER 25-09-2020 Heard Mr. Nawal Kishore Agrawal, learned senior counsel for the petitioner and Mr. Shyam Kumar Singh, learned Additional Public Prosecutor appearing for the State through video conferencing.
Petitioner seeks regular bail in connection with Patori P.S. Case No. 18 of 2020 registered for the offence punishable under Section 395 of the Indian Penal Code, 1860 . The allegation against the petitioner as per the First Information Report is that five unknown criminals entered the office of L.I.C. Sahpur Patori Branch and on the point of pistol looted a sum of Rs. 10,71,803/- Learned senior counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged
Patna High Court CR. MISC. No.23047 of 2020(4) dt.25-09-2020 2/3 and he has falsely been implicated in this case on the basis of confessional statement of the co-accused Manjeet Kumar. Learned senior counsel further submits that the petitioner is an agent of L.I.C and on the date of occurrence i.e. on 20th January, 2020 the petitioner had gone to the Branch for the purposes of depositing premium of his client. Learned senior counsel further submits that petitioner is also an agent of Sahara Credit Cooperative Society Ltd. Learned senior counsel also submits that petitioner was arrested by the Police five days after the date of occurrence on 25.02.2020 and a sum of Rs. 20,000/- was recovered from the pocket of the petitioner along with one mobile phone. Learned senior counsel next submits that petitioner has not been put on T.I.P.
Learned senior counsel also submits that mobile phone in question belongs to the petitioner and petitioner has got no criminal antecedent and he is in custody since 26.02.2020.
Patna High Court CR. MISC. No.23047 of 2020(4) dt.25-09-2020 3/3 custody since 26.02.2020 , I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IVth, Samastipur / court concerned in connection with Patori P.S. Case No. 18 of 2020 on the following condition:- (i) that the petitioner shall remain present on each and every date during the course of trial and in case of default on two consecutive dates on the part of the petitioner, his bail bond shall be liable to be cancelled.
It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding lockdown and social distancing.
