JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-07-2019 This is an application for grant of anticipatory bail in connection with Cheriya Bariarpur P.S. Case No.111 of 2016, disclosing offence under Section 366A of the Indian Penal Code.
Allegation against the petitioner is of kidnapping the minor daughter of the informant.
Submission of the learned counsel for the petitioner is that the whole allegation is false and concocted, as it will appear from the statement of the girl under Section 164 of Cr.P.C., in which she has categorically stated that she has gone on her sweet will with the petitioner and other accused persons. Heard learned A.P.P. also, who opposed the prayer for anticipatory bail on the ground that girl is minor, which will appear from the statement under Section 164 of Cr.P.C..
