2. The petitioner is apprehending his arrest in connection with Janta Bazar P.S. Case No. 160 of 2025 for the offence under Sections 126(2), 115(2), 118(1), 109, 303(2), 351(2), 352 and 3(5) of the BNS.
3. The prosecution case, in brief, is that while the informant was at his residence, Imran Ali, and M. Kaif Ali, arrived at his house for settlement of a dispute. Soon after, Uzail Khan (petitioner) arrived at the informant's house along with other accused persons. It is alleged that instead of discussing the matter peacefully, all the accused persons started abusing the informant in filthy language. No.32350 of 2026(2) dt.07-05-2026 2/3 the scuffle, accused Shami is alleged to have struck the informant with a stick on his arms and chest, causing injuries, while accused Shohrab Bali allegedly attacked the informant on his neck with a sharp-edged knife with an intention to kill him, as a result of which the informant sustained injuries on his face while trying to save himself.
4. Learned counsel for the petitioner submits that the petitioner is quite innocent and has falsely been implicated and has not committed any offence. There is case and counter case between both the parties i.e. Janta Bazar P.S. Case No. 162 of 2025 dated 09.07.2025 filed by the petitioner's wife namely Afrina Khatoon against the informant and five others. As per F.I.R., there is no allegation of assault against the petitioner.
5. Learned APP opposes the prayer for bail.
6. Keeping in view the aforesaid facts, this Court is inclined to extend him the privilege of anticipatory bail.
7. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the date of receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, First Class, Saran, Chapra, in connection with Janta Bazar P.S. Case No. 160 of
Patna High Court CR. MISC. No.32350 of 2026(2) dt.07-05-2026 3/3 2025 subject to the conditions as laid down under Section 482 of B.N.S.S., as also with the condition that one of the bailors should be close relative of the petitioner.
