JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 09-03-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered in connection with Kuchaikot P.S.Case No. 244 of 2020 for the offences punishable under Sections 302/34 of the Indian Penal Code .

As per prosecution case, the son of the informant had left for his aunt's house but never returned. Later, his dead body was recovered behind the showroom of Tata Motors. The name of petitioner has been suspected in this case only on the ground that shortly before the occurrence, 10 persons including the petitioenr had threatened the informant that her son would be

Learned counsel for the petitioner submits that beyond the aforesaid statement of the informant, there is no other material to connect the petitioner with the said offence. On similar footing, two co-accused persons have been granted bail by co-ordinate Bench of this Court in Cr. Misc. No.24128 of 2021 and cr. Misc. No. 711 of 2021.

Learned Additional Public Prosecutor opposed the bail prayer of the petitioner.

Considering the facts and circumstance of the case as well as submission of the parties, let the petitioner in the event of his arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, VII, Gopalganj in connection with Kuchaikot P.S Case No. 244 of 2020 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
