====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 01-07-2016 Heard the learned counsel, Mr. Vaidehi Raman Prasad Singh for the petitioners.

Perused the order dated 27.07.2015 passed by Munsif, Sheohar in Eviction Suit No.1 of 2009 whereby the Court below rejected the application filed by the petitioner for sending the disputed signature to the expert for comparison with the admitted signature.

From perusal of the order, it appears that the Court below clearly recorded finding that earlier the disputed signature was sent to the expert for comparison and report has already been submitted and no objection to the report has been filed by the present petitioner. The report is still alive, therefore, for the second time, there is no question of obtaining second report is required. In view of the above facts and circumstances that there is already a report, in my opinion, this is not a fit case for exercising

Patna High Court CWJC No.19460 of 2015 (2) dt.01-07-2016 supervisory jurisdiction.

Thus, this writ application is dismissed.
