The petitioner seeks regular bail in connection with Hathuwa P.S.Case No.15 of 2019 registered for offences punishable under Sections 363, 364, 302, 201/34 of the Indian Penal Code.

Prosecution story is that the informant after handing over her son to her mother-in-law went to the market and in the evening when she came back, his son Rahul Kumar was found missing and she came to know that her son and one another boy were playing near the Darwaza of Harban Baitha and in spite of search they were not founding and later on dead boy was found from the pond and during investigation, the petitioner has been made accused on the basis of suspicion.

No.25231 of 2019(3) dt.22-05-2019 2/2 Submission of the learned counsel for the petitioner is that except suspicion there is no other substantial material against the petitioner even of last seen along with the petitioner and she is in custody since 30.1.2019 as well as the charge sheet has already been submitted in this case. Furthermore she is a lady.

Heard learned A.P.P. and the learned counsel for the informant. They have opposed the prayer for bail but in spite of query they could not bring any other substances except suspicion against the petitioner. .

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Gopalganj in connection with Hathuwa P.S.Case No.15 of 2019. With the above direction, this application is allowed.
