In this case, the petitioner is apprehending his arrest in connection with Complaint Case No. C-423 of 2017, Trial No. 2791 of 2017 in which cognizance has been taken under Section 420, 467 and 468 of the Indian Penal Code. As per allegation made in the Complaint Petition, there was a partition of the land in the family and the land was allotted in favour of the Complainant but, wrongly, the land has been executed by the present petitioner and, for that, already a civil suit is pending.

Looking to the entire facts and circumstances of

Patna High Court Cr.Misc. No.18715 of 2018(2) dt.06-04-2018 2/2 the case, let the petitioner, namely, Ramakant Singh, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Motihari, East Champaran in connection with Complaint Case No. C-423 of 2017 (Trial No. 2791 of 2017).
