The petitioner apprehends his arrest in connection with Medanichowki P. S. Case No. 6 of 2016 instituted under Sections 376, 420 and 506/34 of the Indian Penal Code. The allegation in brief is that informant, after being deserted by her husband, was sexually exploited by the petitioner on the pretext of getting married.

It is submitted that the informant is a married lady and her marriage was solemnized in the year 1995 and there is no material to show that she was raped by the petitioner rather due to political vendetta, by setting up this lady, has been falsely implicated in this case as the petitioner is Chairman of Zila Parishad, Lakhisarai.

Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.39010 of 2017 (3) dt.17-10-2017 2/2 circumstances, let the petitioner, namely, Manoj Kumar, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Mednichowaki P.S.Case No. 6 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
